Local Music Veteran Sues Hayward Over Ordinance

Local musician Molly Otis Scheer filed a lawsuit on August 11 against the City of Hayward. Otis, of Molly and the Haymakers and Mike Perry and the Long Beds, is suing the city for its music ordinance that was enacted three years ago. The ordinance bans outdoor music, live or recorded, after 10pm within the city limits unless a permit is obtained from the city council. As the owner of The Pavilion-Wine Bar and Shops in Hayward, Molly Otis Scheer attempted to attain a permit last month in order to have live music outdoors between 10pm and 1am on Friday and Saturday nights, but was denied. She is suing under the claim that the ordinance and refusal of a permit restrict her First and Fourteenth Amendment rights to freedom of speech/expression and protection from government-driven deprivation of life, liberty, or property, respectively. The city has 20 days to respond to the lawsuit.
